A. Standard Terms & Conditions

1. Scope of application

1.1. These Standard Terms & Conditions of Frank Müller (hereinafter "the Seller") apply to all contracts which a consumer or a business (hereinafter "the Customer") concludes with the Seller for the goods and/or services offered by the Seller in his online shop. The application of the Customer's own terms and conditions is hereby excluded, unless agreed otherwise.

1.2. A consumer within the meaning of these Standard Terms & Conditions is deemed to be any individual who enters into a legal transaction for a purpose that cannot be attributed to his or her commercial or self-employed activities. A business within the meaning of these Standard Terms & Conditions is deemed to be any individual or legal entity or partnership with legal capacity who, upon entering into a legal transaction, acts as part of their self-employed or commercial activity.

2. Conclusion of contract

2.1. The product descriptions in the Seller's online shop do not constitute a binding offer on the part of the Seller, but merely serve to invite the Customer to make a binding offer.

2.2. The Customer may make any such offer in writing, by fax, e-mail or via the online order form available in the Seller's online shop. By placing an order via the online order form after entering personal data and clicking on the "Buy" button as the final step of the order process, the Customer makes a legally binding offer to contract for the goods contained in the shopping basket.

2.3. The Seller may accept the Customer's offer in writing (by letter) or by way of an electronic order confirmation (by fax or e-mail) or by delivering the goods within five (5) days. The Seller is entitled to reject the order.

2.4. Order processing and contact are usually effected via e-mail and automated order processing. The Customer shall ensure that the e-mail address provided for order processing purposes is correct, so that the Customer is able to receive e-mails from the Seller using this address. More specifically, when using spam filters, the Customer shall ensure that all e-mails sent by the Seller or any third parties instructed by the Seller to handle the order processing can be delivered.

3. Right of return

Where the Customer is deemed to be a consumer, the Customer will be granted an unqualified right of return instead of a revocation right. The Seller's Instructions on the Right of Return set out the details regarding the right of return. 4. Prices and terms of payment

4.1. The prices quoted by the Seller are final prices and include German statutory value-added tax. Any delivery or shipment costs will be quoted separately in the relevant product description contained in the offer.

4.2. The Seller offers the following payment options for deliveries within Germany, unless otherwise provided in the relevant product description contained in the offer:

• Cash before delivery by bank transfer
• PayPal
• Payment via sofortbanking (Sofortüberweisung)
• Cash on delivery
• Credit card (Visa, Mastercard, American Express)

4.3. Where delivery to an address outside Germany is offered for the relevant item, the Customer has the following payment options for deliveries outside Germany, unless otherwise provided in the relevant product description contained in the offer:
• Cash before delivery by bank transfer
• PayPal
• Payment via sofortbanking (Sofortüberweisung)
• Credit card (Visa, Mastercard, American Express)

4.4. For deliveries to countries outside the European Union, additional costs may arise on a case-by-case basis, over which the Seller has no control and which must be borne by the Customer. This includes, for example, costs for money transfers via banks (such as transfer charges or foreign currency service fees) and import levies or taxes (e.g. customs duties).

4.5. Where cash before delivery has been agreed, payment is due immediately upon contract conclusion.

4.6. When selecting payment by credit card, the Customer's credit card account will be debited immediately upon acceptance by the Seller pursuant to No. 2.3 of the Seller's Standard Terms & Conditions (see above).

5. Delivery and shipping terms

5.1. As a rule, the goods are shipped to the delivery address provided by the Customer. For the processing of the transaction, the delivery address stated in the Seller's order processing system will be decisive. The preceding sentence notwithstanding, if the PayPal payment option is selected, the delivery address held by PayPal at the time of payment will be decisive.

5.2. In the event that the transport company returns the goods to the Seller, as delivery to the Customer was not possible, the Customer shall bear the costs of any failed delivery. This does not apply if the Customer exercises the Customer's right of return by refusing acceptance, if the cause for such failed delivery is not attributable to the Customer or if the Customer was temporarily prevented from accepting delivery, unless the Seller has advised the Customer within a reasonable timeframe of the impending delivery.

6. Warranty for defects

The statutory warranty for defects applies.

7. Applicable law

7.1. The entire legal relations between the parties are governed by the laws of the Federal Republic of Germany, to the exclusion of any laws on the international sale of moveable goods. For consumers, this choice of law applies only insofar as the protection afforded by mandatory provisions under the laws of the country in which the consumer ordinarily resides has not been compromised.

7.2. The contract language is German.

2. Information regarding essential characteristics of the good or service

The essential characteristics of the good or service are set forth in the relevant product description provided by the Seller.

3. Information on the formation of contract

The contract comes into existence in accordance with No. 2 of the Seller's Standard Terms & Conditions (see above).

4. Information on payment and delivery

Payment shall be made in accordance with No. 4 and delivery shall be made in accordance with No. 5 of the Seller's Standard Terms & Conditions (see above).

5. Information on the technical steps that lead to contract conclusion

Contract conclusion is effected by way of offer and acceptance.

5.1. Where the Customer orders via the Seller's online order form, the Customer will place the order as follows:

5.1.1. As a first step, the Customer clicks on the "Shopping Cart" button on the Seller's product offer page. This opens a new page which shows the content of the shopping basket. You can change the number of items in the shopping basket by entering a new quantity in the "Qty" field. The shop then automatically recalculates the total price.

5.1.2. As a second step, either immediately or after placing additional goods in the virtual shopping basket, the Customer clicks on the "Check Out" button. If the Customer does not yet have an account or has not logged in, another page opens, where, as an intermediate step, the Customer either has to register as a new account, register without opening a new account or log in if they have already been registered as a customer. Customers already registered as a customer complete the "Your email" and "Your password" fields and then click on the "continue" button. Customers who do not yet have an account must click on the "New Customer" button, if they wish to open a customer account or register without opening a new account by clicking on the "Guest Order" button. They then fill in the form and click on the "Continue" button. This opens a new page which shows invoice address and delivery address and provides the opportunity to update addresses, to add new addresses and to select the mode of shipping.

5.1.3 As a next step, the Customer clicks on the "Continue" button.

5.1.4. This opens a new page on which the Customer must, as a fourth step, select the payment type by clicking on the relevant fields.

5.1.5. As a next step, the Customer clicks on the "Continue" button. A new page opens which summarises the order details.

5.1.6. As a next step, with a click of the mouse, the Customer places a tick in the field that reads: "I agree to the data protection provisions and the Standard Terms & Conditions and confirm that I have read the Instructions on the Right of Return".

5.1.7 As a final step, the Customer clicks on the "Buy" button.

5.2. Acceptance by the Seller will be effected in accordance with No. 2.3 of the Seller's Standard Terms & Conditions (see above).

6. Information on storing the text of the contract

The Seller will save the text of the contract and, upon order placement, forward it to the Customer together with these Standard Terms & Conditions and Customer Information in text form (e.g. by e-mail, fax or letter). In addition, the text of the contract will be archived on the Seller's website and can be retrieved, at no cost, by the Customer via the password-protected customer account, using the correct log-in data, provided that the Customer has opened a customer account in the Seller's online shop before placing the order.

7. Information about the technical means to identify and correct input errors

Prior to the placement of a binding order, the Customer can check the entries via the standard keyboard and mouse functions at any time. In addition, all entries will be displayed once again in a confirmation window prior to the placement of a binding order and can be corrected via the standard keyboard and mouse functions.

8. Information about the languages available for contract conclusion

The contract can only be concluded in the German language.
